Fees: You agree to pay all fees specified in your selected subscription plan. All fees are exclusive of taxes, which you are responsible for paying.
Billing: We use Stripe as our third-party payment processor. By using our service, you agree to Stripe’s Services Agreement.
Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account dashboard before the renewal date.
Refunds: Except as required by law (including the Australian Consumer Law), all fees are non-refundable. We do not provide credits or refunds for partial subscription periods or unused indexing credits.
Our software integrates with Google Search Console and Bing Webmaster Tools. Your use of IndexWisely is also subject to the Google APIs Terms of Service and Bing Webmaster Guidelines.
We are not responsible for any changes, outages, or restrictions imposed by these third-party providers.
Usage Limits: We reserve the right to monitor usage and throttle or suspend accounts that exceed reasonable "fair use" limits or bypass our API protections, which could negatively impact our service infrastructure.
Our Service: The IndexWisely software, logo, design, and code are the exclusive property of IndexWisely. We grant you a limited, non-exclusive license to use the service.
Your Content: You retain all ownership rights to your website data, content, and sitemaps ("User Content") that you connect to the service. By using IndexWisely, you grant us a limited license to access and process this content solely to provide the indexing services.
"As Is" Clause:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
Search Engine Results: While IndexWisely facilitates the submission of URLs, we do not guarantee that search engines will index or rank submitted content, as these decisions are at the sole discretion of the third-party providers.
"Our Shield":
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDEXWISELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO INDEXWISELY DURING THE 12 MONTHS PRIOR TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of **Australia**, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Australia.
